Deposits and Payments
A 100% deposit is required at the time of reservation and is charged to the Visa, Mastercard, American Express, or Discover card provided. Any additional charges for upgrades, add-ons, dining at Black Sage (our on-site restaurant), or incidentals will be processed on the day of check-in or after departure, if necessary, unless other payment arrangements have been made.

By proceeding with your reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms and  Conditions and the Waiver of Liability.

Room Rates
All rates are quoted in United States currency and are subject to applicable state and local sales taxes and fees. Rates as advertised on the Open Sky Resort website or through other promotional materials are subject to change at any time and may increase or decrease at the resort’s discretion without notice. Open Sky Resort reserves the right to correct or clarify any errors in pricing or related materials and to cancel, modify, or adjust reservations made under incorrect pricing, changes in state or local sales tax, even after confirmation, provided notice is given to the guest. Once a reservation is confirmed and payment is received, the rate for that booking will not change.

Guest Eligibility and Identification
Guests must be at least 18 years of age to make a reservation and stay at Open Sky Resort. A valid, government-issued photo ID is required at check-in.

Room Occupancy
Only registered guests are permitted to stay overnight in the rooms. Room occupancy limits are fixed and cannot be exceeded for safety and compliance reasons. Each tent must have at least one registered guest aged 14 years or older, given that the reservation was made by an adult 18 years and older who is also staying on the property as noted in the Guest Eligibility and Identification section. Children may not occupy a tent without a guest meeting this age requirement.

Pets and Service Animals
Pets are not permitted, except for certified service animals as defined by ADA guidelines. All service animals must remain on a leash and under the owner’s control at all times. Service animals may not be left unattended in the camp. Guests are responsible for any damages or excessive cleaning determined by resort management resulting from a service animal. Open Sky reserves the right to ask a guest to remove an animal from the property if it is disruptive, aggressive, or not under control.

Check-In and Checkout Policy
Check-in:
3-9 p.m.
Checkout: 11 a.m.

Early check-in or late checkout is not guaranteed. Please plan your travel accordingly. If you anticipate arriving after 9 p.m., please call ahead to arrange a late check-in.

Unapproved late checkouts will incur an additional fee.

Damage, Lost Items, and Incidentals
Guests are responsible for any damage to accommodations, furnishings, or property during their stay beyond normal wear and tear. This includes, but is not limited to, stains, broken furniture, missing items, or excessive cleaning due to misuse.

By booking, guests authorize Open Sky Resort to charge the card on file for any damages or missing items identified within 48 hours after checkout. Notification of such charges will be sent to the guest’s email address on file. Our team may document damages with photos as part of our process.

Many items provided in your camp are for in-room use only and are not intended for take-home use. These include, but are not limited to:
* Robes, yoga mats, lanterns, and blankets
* Furniture (indoor & outdoor)
* Terry cloth towels and linens
* Reusable soap and amenity dispensers

Missing items will incur a replacement fee equal to 120% of the item's cost, plus any applicable shipping and handling costs. Select room items are available for purchase; please ask the front desk or see the retail shop.

Open Sky Resort is not responsible for lost, stolen, or forgotten items left in guest tents or on property. Lockable tents are provided for guest use; however, guests are responsible for securing their belongings.

Lost and Found
Open Sky Resort assumes no liability for lost, misplaced, or stolen items. Items left behind will be kept for 30 days and then donated or disposed of. Upon request, we will return items via mail; guests will be charged $30, which covers packaging, postage, and handling fees.

Parking
Private camp parking is provided for registered guests. All vehicles are parked at the guests’ own risk. Open Sky Resort is not responsible for damage, theft, or accidents that occur while vehicles are on the property.

Use of Recreational Equipment
Guests using on-site recreational equipment, such as mountain bikes, pond equipment, and outdoor games, do so at their own risk. Open Sky Resort is not responsible for injuries, accidents, or damages resulting from the use of these amenities. Guests agree to supervise minors when using such equipment and assume full responsibility for safe operation.

Black Sage Restaurant and Food Services
Guests dining at Black Sage Zion (a DBA of Open Sky Resort LLC) acknowledge and accept the inherent risks associated with food service and consumption. Open Sky Resort and Black Sage are not responsible for adverse reactions due to food allergies or dietary restrictions unless advance notice has been provided and accommodations confirmed in writing.

Guests also acknowledge that complimentary food offerings, including grab-and-go breakfast items and snacks provided in accommodations, are not prepared in a certified allergen-free environment. Consumption of any food provided is at the guest’s own risk.Guests are responsible for supervising minors at all times while in dining areas. Open Sky reserves the right to refuse service or ask guests to leave the restaurant if their behavior disrupts other diners or violates resort rules.

Cancellation and No-Show Policy

For stays prior to January 8, 2026:
Cancellations must be made at least 21 days prior to arrival to receive a full refund, minus a $25 processing fee.
Cancellations made within 21 days of arrival are non-refundable.
No refunds for shortened stays, late arrivals, no-shows, or early departures.
Travel insurance is highly recommended.

For stays on or after January 8, 2026:
Cancellations must be made at least 45 days prior to arrival to receive a full refund, minus a $100 processing fee.
Cancellations within 45 days of arrival are non-refundable.
No refunds for shortened stays, late arrivals, no-shows, or early departures.
Travel insurance is highly recommended.

Refunds will be issued to the original payment method within 14 business days.

Smoking, Drones, and Quiet Hours
Open Sky Resort is a smoke-free property. Smoking and vaping are strictly prohibited in tents/camps and all common areas. A $500 cleaning fee will be charged for any violation.Drones are prohibited on the property to ensure the privacy of other guests unless prior written permission is granted by resort management.Quiet hours are from 9:30 p.m. - 8 a.m. to ensure all guests enjoy a peaceful environment.

Housekeeping and Room Access
Housekeeping service is provided daily between 8 a.m. and 2 p.m. For extended stays, bed linens are rotated every three days. Even when a “Do Not Disturb” sign is displayed, management, housekeeping, or maintenance staff reserves the right to enter the tent for safety, maintenance, or operational reasons.

Behavior and Removal Policy
Open Sky reserves the right to refuse service or require a guest to leave without a refund if their behavior endangers others, violates resort rules, causes a disturbance, or damages property. This policy applies to all areas of the resort, including Black Sage Restaurant.

Off-Grid Utilities and Service Interruptions
As an off-grid property, Open Sky Resort relies on alternative power, water, and communication systems. While we make every effort to provide uninterrupted services, there may be occasions when utilities are temporarily unavailable due to circumstances beyond our control. Guests acknowledge and accept this as part of the unique off-grid experience and agree that no refunds or credits will be issued for brief service interruptions.

Additional Resort Policies

Right to Refuse Service:
Open Sky Resort is privately owned and operated. We reserve the right to refuse service or remove any guest for reasons that do not violate federal or state law.

Supervision of Minors: Parents, guardians, or chaperones are responsible for supervising minors at all times, including in dining areas and throughout the property.

Firearms & Hazardous Materials: Guests may not bring firearms, explosives, or hazardous substances onto resort property. Exceptions apply to law enforcement on duty.

Alcohol Policy: Alcohol may only be consumed in guest tents or designated areas. Alcohol service at Black Sage is subject to Utah state law and requires guests to show valid identification.

Visitors: No visitors are allowed on the property after 9:30 p.m. unless approved by resort management.

Light Pollution: Avoid the use of car high beams, high-lumen flashlights, laser lights, and unnecessary light pollution during the evening hours.

Assumption of Risk, Waiver of Liability and Indemnity Agreement

By booking a reservation with Open Sky Resort LLC (“Open Sky Zion”), I acknowledge and voluntarily enter into this Assumption of Risk, Waiver of Liability, and Indemnity Agreement (“Agreement”) on behalf of myself, my minor children (if applicable), and my heirs and/or representatives.

I understand that staying at Open Sky Zion involves inherent risks associated with:
* Inclement weather (extreme temperatures, fire, wind, ice)
* Rugged terrain, insects, snakes, and wild animals
* Limited access to medical facilities
* Utility service interruptions due to the off-grid nature of the property
* Unforeseen or unanticipated hazards, including natural disasters (wildfires, rockfalls, flash floods, earthquakes)

I voluntarily assume full responsibility for these risks, including any resulting injury (serious injury or death) or property damage.

I agree to waive, release, indemnify, and hold harmless Open Sky Zion and its officers, directors, agents, employees, contractors, volunteers, representatives, and property partners (collectively, “Releasees”) from any and all claims or causes of action arising from my stay, including those caused by the ordinary negligence of Releasees. This waiver covers all activities and dining experiences at Black Sage. This waiver does not extend to claims resulting from gross negligence or willful misconduct.

I further agree:
* To supervise any minors in my care at all times.
* Open Sky Zion is not responsible for injuries or damages caused by third-party vendors or activities.
* To resolve disputes through binding arbitration in Washington County, Utah, and waive the right to pursue claims as part of any class action lawsuit.

Force Majeure
Open Sky is not responsible for delays, cancellations, or damages resulting from natural disasters, acts of God, pandemics, utility service interruptions, or other events beyond its control.

Media Release
I grant Open Sky Zion and Black Sage Zion permission to use photos, videos, and content shared or posted by me to social media channels or websites for promotional purposes, provided such use does not infringe upon my privacy or portray me in a defamatory manner.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah. If any provision is found unenforceable, the remainder shall remain in effect.

Open Sky Resort LLC may amend this Privacy Statement from time to time in order to meet changes in the regulatory environment, business needs, or to satisfy the needs of our guests, properties, strategic marketing partners, and service providers. Updated versions will be posted to our web site and date stamped so that you are always aware of when the Privacy Statement was last updated.

OUR MISSION
At Open Sky Resort LLC, Inc. (“Open Sky” or “Open Sky Resort LLC”), we are dedicated to protecting your privacy and safeguarding your personally identifiable information (including, but not limited to, an individual’s name, address, phone number and/or e-mail address). Our mission is to deliver quality products and services to our guests. We strive to create an experience that is responsive to our guests’ needs by using the information you entrust us with responsibly. We are committed to respecting your privacy and adhering to the principles of applicable data protection and privacy laws throughout the world. We have provided this Privacy Statement as an explanation of the information we collect, how we use it, how the use of this information can benefit your experience on our websites and during your relationship with us, with whom and for what purposes we may share the information, and the choices you can make about our use of the information. We also describe the measures we take to protect the security of the information and how you can contact us about our privacy practices. We wish to help you make informed decisions, so please take a moment to read the sections below.

What information do we collect?

We collect your first and last name, email address, postal address, phone number, and other similar contact data.

Credentials. We collect passwords, password hints, and similar security information used for authentication and account access.

Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions.   All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.  

Information automatically collected

In Short:
Some information – such as IP address and/or browser and device characteristics – is collected automatically when you visit our Sites.

We automatically collect certain information when you visit, use or navigate the Sites. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites and other technical information. This information is primarily needed to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes.

We use personal information collected via our Sites for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

To send you marketing and promotional communications. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time (see the ” WHAT ARE YOUR PRIVACY RIGHTS ” below).

By booking, you authorize Open Sky Zion to send text messages and emails with details regarding your reservation information and other offers. Message/data rates may apply. Consent is not a condition of purchase.          

To post testimonials.
We post testimonials on our Sites that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. If you wish to update, or delete your testimonial, please contact us at experience@stayopensky.com and be sure to include your name, testimonial location, and contact information.
           
Deliver targeted advertising to you. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.                

Request Feedback.
We may use your information to request feedback and to contact you about your use of our Sites.                  

To protect our Sites.
We may use your information as part of our efforts to keep our Sites safe and secure (for example, for fraud monitoring and prevention).                      

To enforce our terms, conditions and policies.
         

To respond to legal requests and prevent harm.
If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.                          

For other Business Purposes.

Will your information be shared with anyone?

In Short: We only share information with your consent, to comply with laws, to protect your rights, or to fulfill business obligations.  We may process or share data based on the following legal basis:

Consent: We may process your data if you have given us specific consent to use your personal information in a specific purpose.

Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.

More specifically, we may need to process your data or share your personal information in the following situations:  

Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Sites, which will enable them to collect data about how you interact with the Sites over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

Third-Party Advertisers. We may use third-party advertising companies to serve ads when you visit the Sites. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.    

Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.      

Business Partners. We may share your information with our business partners to offer you certain products, services or promotions.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy.       

How long do we keep your information?

In Short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.  

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 1 year past the termination of the user’s account.

When we have no ongoing legitimate business needs to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
     

How do we keep your information safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.  

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Sites at your own risk. You should only access the services within a secure environment.    

Do we collect information from minors?

In Short:  We do not knowingly collect data from or market to children under 18 years of age.  

We do not knowingly solicit data from or market to children under 18 years of age. By using the Sites, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Sites. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. What are your privacy rights?

In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.  

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details  provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.  

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. Account Information  If you would at any time like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.    

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites. To opt-out of interest-based advertising by advertisers on our Sites visit send us an email to experience@stayopensky.com.      

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may:

■  Note your preferences when you register an account with the site.  
■  Contact us using the contact information provided.

CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.    

Do California residents have specific privacy rights?

In Short:  Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.  

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Sites, you have the right to request removal of unwanted data that you publicly post on the Sites. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Sites, but please be aware that the data may not be completely or comprehensively removed from our systems.
     

Do we make updates to this policy?

In Short:  Yes, we will update this policy as necessary to stay compliant with relevant laws.  

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible.
